the Fondazione Teatro Massimo, located in piazza Verdi 90138 Palermo, VAT no. 00262030828, in the person of its legal representative pro tempore (e-mail: sovrintendenza@teatromassimo.it), in its capacity as Data Controller, wishes to inform you that the European Reg. 2016/679 “General Data Protection Regulation” – GDPR (which in part replaces the previous “Privacy Code” Legislative Decree 196/03) provides for the protection of individuals with with regard to the processing of personal data.
This Privacy Policy is in force when you visit our APP “Teatro Massimo App” available on the
official IOS and ANDROID market stores.
In accordance with the provisions of Art. 13 of EU Reg. 2016/679, we therefore provide you with this information.
Data collected
Users are created manually at the Controller’s premises at the specific request of the person concerned; the necessary data are stored in the relevant database on the website.
No personal data are collected through the mobile application except those strictly necessary to
allow the proper functioning of the App, such as the notification system, and the position of the device while using the Teatro Massimo App, subject to a specific request for permission. Access to the location is aimed at receiving invitations and offers for users who are near the Theatre.
The tracking services implemented store the information collected in an automated manner (and in an
exclusively aggregated form) in order to verify the proper functioning of the Teatro Massimo App and to apply the appropriate optimisations. None of this information is related to the physical person-user of the Teatro Massimo App, and do not allow in any way its identification.
Recipients
Data of a personal nature that may be provided may only be disclosed to appointed recipients who will process the data in their capacity as data processors and/or authorised persons.
The disclosure of personal data is in any case excluded.
The full list of the persons responsible for the processing of the relevant personal data may be requested by sending an appropriate request to the contact details of the Data Controller indicated in this document.
Purpose of data processing
Data are processed exclusively for the purposes for which they are collected, as described below. The Data Controller uses the data provided by data subjects to:
- Perform the services made available through the app;
- Manage the account of registered users to use the related services offered by the Data Controller;
- Fulfill legal obligations, regulations, EU legislation;
- Providing offers and invitations to users in relation to the location of the device.
Depending on how you interact with our APP, the purposes for which the Fondazione Teatro Massimo collects your Personal Data and the legal basis on which the processing is based are listed below:

Processing methods
The data collected is processed according to the security requirements prescribed by the current legislation to prevent loss of data, unlawful or incorrect uses and unauthorized accesses. Data are stored on servers located in European territory.
Personal Data processed for the above purposes will be kept in accordance with the principles of proportionality and necessity until the purposes of the processing have been fulfilled, in accordance with our data retention policies and applicable data protection laws. When we no longer need your personal information, we will remove it from our systems and records or make it anonymous so that you can no longer be identified from it.
Data security is a top priority for our company, and appropriate technical and organisational security measures are implemented for all processing. Specific security measures are observed to prevent data loss, illegal or incorrect use and unauthorised access. Data are stored on servers in the European area and their availability is guaranteed by specific business continuity measures.
Rights of the interested party
According to Articles 15 – 22 of EU Regulation 2016/679 each interested party is granted a number of rights:

- right to restriction of processing
- right to data portability
- right to object to processing

Should the Data Controller fail to provide you with a response within 30 days of your request or should you verify a violation of your rights, you may refer to the competent supervisory authority, Garante della Protezione dei dati, according to Article 77 of EU Regulation 679/2016.
